Ordering & Occupational Health Care
Section 2 of the Occupational Safety Act (ASiG) stipulates that your company has appointed a company doctor (appointment).
DGUV Regulation 2 specifies how occupational health care and advice should be provided (occupational health care).
Thus, two acts must be distinguished:
- Act – appointment with a certificate of appointment and definition of tasks
- Akt – the advice and support, which fundamentally includes the inspections and participation in the ASA meetings (§ 11 ASiG)
The appointment of the company physician in accordance with § 2 ASiG
Appointment of the company doctor
- This is done by means of a certificate of appointment stating the area of responsibility for which the company doctor is appointed.
- The certificate of appointment shall be of an official nature. It should be displayed.

Is there an obligation to provide occupational health care?
- Section 2 of the Occupational Safety Act (ASiG) includes the obligation to appoint the company doctor.
- The so-called DGUV Regulation 2 (Accident Prevention Regulation for Company Physicians and Occupational Safety Specialists) obliges the employer to seek advice and specifies the scope of care.

The DGUV regulation distinguishes between
Company:
- with <10 employees (Annex 1 to § 2 para. 2 DGUV regulation
- with > 10 employees (Annex 2 to § 2 para. 3 DGUV regulation). - Companies in Frankfurt with up to 10 employees are advised to seek advice on the preparation of the risk assessment.
- Companies in Frankfurt with more than 10 employees are obliged to receive advice from a company doctor in addition to the order.

How often is occupational health care provided?
- In general terms, the scope of support depends on the number of employees, the industry, the degree of risk of the activities your employees perform and the accident rate at work.
- The specific need for care is determined in hours per employee.
- The required number of hours of care per employee is determined and binding by your employers' liability insurance association.
- Important to know – brarbe efficiency tip: You can weight your mandatory care hours accordingly, example: Obligation to provide 10-hour care: 80% can be provided by the occupational safety specialist, 20% by the company doctor.

Employers in Frankfurt are obliged to assess the working conditions of every planned and existing job (§ 5 ArbSchG).
This is called risk assessment.

brarbe helps you to carry out the ASA. In companies with more than twenty employees, the employer must form an occupational health and safety committee in accordance with § 11 ASiG. When determining the number of employees, part-time employees with a regular weekly working time of no more than 20 hours are to be taken into account at 0.5 and no more than 30 hours at 0.75. This committee is composed of:
- the employer or a person appointed by the employer
- two works council members appointed by the works council
- Company physicians
- Occupational safety specialists
- Safety officer (§ 22 SGB VII)
The occupational health and safety committee must be held quarterly.
The regular meeting of the Occupational Health and Safety Committee has the purpose of consciously and permanently keeping occupational health and safety present as a topic.
