FAQ
The entrepreneur is always responsible! This follows from § 21 I of Book VII of the Code of Social Law. This regulation is dispositive, i.e. indispensable. Section 13 ArbSchG includes “superiors”/personnel managers in the responsibility, so that in the end the employer and his selected representatives are responsible.
Accountability is closely related to liability. If someone is “responsible”, the claims for damages are directed at this person. Criminal law is also directed against the responsible persons. If legal provisions are not fulfilled and employees or customers are injured, the omission offences are relevant. Example: negligent bodily injury due to failure to install fire protection equipment.
The fire protection officer, the safety specialist/occupational safety specialist and the occupational physician/company doctor are not responsible in the legal sense. They are more likely to be “responsible”, contact persons and “guardians” of occupational safety. Their activity is consulting. brarbe also sees itself and its advisors as guardians of occupational safety. This means that not only occupational health and safety questions are answered, but problems are also proactively addressed. After all, effective occupational health and safety has not been proven to have a negative effect on the economic balance.
From a legal point of view, it is not possible to give a general answer to this question. The law basically stipulates in § 1 ASiG (Occupational Safety Act) that advice or appointment must always be provided by an occupational safety specialist and a company doctor. DGUV Regulation 2, which is not a law but a regulation, states that an order must only be placed by the entrepreneur from 10 employees. Thus, safety and occupational health care is mandatory in any case from 10 employees. If you have fewer than 10 employees, there are special support models at your employers’ liability insurance association. Nevertheless, you are always free to choose your care model.
In terms of fire protection, it is more extensive. On the one hand, building regulations of the respective country can oblige a contractor to have appointed a fire protection officer (especially for companies with guests, customers and patients). On the other hand, the legally required risk assessment (§ 5 ASchG) is relevant here. If the risk assessment shows an increased fire risk for the company, a fire protection officer must also be appointed!
The occupational safety specialist (modern) and the safety specialist are synonymous terms. Before 2009, the term safety specialist was relevant, but today, with the establishment of the DGUV regulations, it is the term occupational safety specialist.
The company doctor, the occupational physician and the occupational medicine specialist have different titles, as they have all completed different training and study phases.
All three designations are allowed to provide occupational health advice in accordance with DGUV Regulation 2. What they have in common is that they all have a degree in human medicine and a license to practice medicine.
Fire protection in Frankfurt
Companies in Frankfurt may be legally obliged by the respective building regulations to employ or have appointed a fire protection officer. This includes, in particular , nursing homes, hospitals or sales outlets of a certain size, as these regularly include external persons (patients, customers, visitors) in addition to employees.
There is also a legal obligation to appoint a fire protection officer in Frankfurt if the risk assessment shows that there is an increased fire risk for the company and therefore qualified advice is required, which can only be guaranteed by a fire protection officer. There may also be an obligation under the insurance contract with the fire protection or liability insurance. For example, insurance companies regularly agree that a fire protection officer must be appointed.

Occupational safety in Frankfurt
Occupational safety should not only be seen as a legal obligation.
Companies that do not comply with the obligation to receive safety advice can be fined severely by the technical supervisors (TAB) of the employers’ liability insurance associations or the competent supervisory authority (occupational health and safety authority of the district/state). Consequences can also be forced inspections with expense allowances or even the prohibition of carrying out the work or the closure of the place of business (until the hazards at the workplace have been analysed and minimised).
Furthermore, there is always the risk of a significant accident at work in which an employee is seriously injured. By disregarding occupational health and safety laws and regulations, the employers’ liability insurance association can assert claims for damages from the employer.
In addition to the claims for damages, criminal law, e.g. negligent bodily injury by omission (failure to order a consultation), is always in the room for the entrepreneur.
